Legal Question in Credit and Debt Law in Missouri
My husband and I have been "owners" in Mid-America Resorts for 11+ years. We told them 2 years ago that we no longer wanted to be owners and forfeited our "deed" (we do not pay state taxes, so the deed is a joke). We tried to give it away, but apparently the general public if far smarter than we are. Mid-America Resorts has been harassing us with phone calls threatening law suits and legal fees unless we pay their yearly maintenance fees of roughly $350/year. We have not been to the resort in over 5 years and have no intentions of returning. We now live in a completely different state.
Are we liable for this maintenance bill?

It depends. What does your contract say about paying maintenance fees and termination? Does your contract comply with Missouri consumer law? If your contract does not comply with Missouri law, it may be voidable. Also, statutes of limitation may serve to cut off liability if a party waits too long to enforce a claim. I would need more information to better advise you. Feel free to contact me if you want to look into this further.
