Legal Question in Credit and Debt Law in Missouri
Judgement Question?
Hello! Have a question, would greatly appreciate any assistance you could provide?
A judgement was rendered against me last year, when I accepted the summons I was told that there was no court date set and that I could dispute the debt (as I was unclear what the debt was or if it was mine). I sent a dispute letter as instructed, and heard nothing more. 2 months ago, whil refinancing our home, I was told there was a judgement on my credit report, they'd gone to court 2 weeks after serving me and it was rendered in default. I was never notified of the judgement. I have since tried to investigate the ''debt'' and there is the strong possibility that it is not valid and/or outside the statute of limitations. How do I resolve this? If they try to collect on the judgement, will I be contacted so I can dispute? Thanks! Help!

Re: Judgement Question?
If garnishment or execution is filed, you will be notified. You will then have a limited amount of time to seek to have ir quashed or recalledd (dispute it). As to disputing the debt, you may not have many options. If you truly believe that the judgmetn is someho wflawed, you should have an attroney in your area look at all the evidence and documents you have in that issue. It may that the title com[pany will not issue a policy regarding your refinancing of your home, without a release of the judgment lien.
Good Luck
