Legal Question in Credit and Debt Law in Missouri
Hello, My name is Kathleen Flohr;I am recently re married.I have a question on an old debt that took place when I lived in Mpls,Mn...I stopped making payments on my credit card,due to money matters in 2004,they served me a judgement back in 2006..unable to pay then and now...It is a debt collector..I do know that the statue of limitations has expired because in Mpls,Mn.because it is 6 years old.Talking with them recently they told me that they have renewed it and they can keep renewing it for up to 20 years if they want...is this true ? And wat can I do about it if anything? I am currently un employed...so is m new husband then lyable for this re-payment? I would think not...Please help me if you can..they keep calling me and I dont know what to say to them ,so I just avoid answering ...Wondering if they are correct or are they just bulling me? I have been in the process of trying to fix my credit, and pay back old debts...But this one is way too big...Is Bankruptcy the only way out??Thank you...Kathleen

In nearly every state, if there has been s valid judgment, then the ststute of limitations is irrelevant. That period is how long they have to take you to court. They already did that. If you live in missouri now, and they haven't registered the judgment hwere, then there is little they can do to yhou, except put it on your credit report. The frwequency to renew a judgment in Missouri is just ten years. If they fail to do that, they may not ever be able to apply the judgment to you, unless you move to a state with a longer renewal period. You should discuss your case with bankruptcy attorney in your area.
