I live in MO and have a payday loan law question. A few weeks ago I took out a payday loan at a Checksmart branch. Once payment came due I allowed them to deposit my check to take care of, and finish, the loan. However, I unknowingly didn't have the funds in my account at the time and my bank returned the check. They contacted me and I agreed to come into the store and pay for the check plus fees in person on the following Friday to settle the matter. However, they redeposited that same check the Thursday before I had agreed to take care of the debt. That check didn't clear as well. What, if any, laws were broken and what rights do I have?

You asked what laws may have been broken. You may be found guilty of passing a bad check. You masy get aletter fromt eh county preosecutor, if you do not at least pay the face amount of the check before a criminal case is filed against you. You have the right to know the itemized costs of making the CheckSmart whole for you mistake. You ahve the right to provide a defense before you are found guilty of passing a bad check.
