Loss of home

I recently lost my home and the morgage company who had the home bought it back. We have moved out already but didn't recieve any papers on the home for almost a month. We have been summons to court , is this just if we want to try to fight for the home or do we not have to appear and they would just get the home back? I figured it was if we wanted to fight it and if we didn't then we don't have to go can you tell me please, thanks.

An attorney would need to read the Petition that was served upon you with the summons in order to be able to give you any advice. I would suggest that in many cases the home loan documents,e.g. the promissory note, the Deed of Trust, or whatever you have in your case probably provide that you owe the lender any deficiency, and this suit is probably a suit for money. I would strongly urge you to have the Petition and summons reviewed by an attorney as soon as possible. Good luck.
