Legal Question in Credit and Debt Law in Missouri
Medical Collection agency
I received a call from Missouri Medical Collections 2 weeks ago. Their acct. rep told me I had to give them my banking info so they could withdraw a monthly payment from my checking acct. If I did not agree to this they would take me to court. I offered to send a monthly payment by check and she would not agree. She said the only choice I had was to let her take the money from my acct. I owe 445.00. I felt I had no other choice so I gave her the acct. number and she still has not taken the payment out. She also said I couldn't make 30.00 a month payments until I gave her all the info on my other monthly debts. After I did, she agreed to 30.00 a month. I have been told that I did not have to give her my account number, but I was afraid of getting sued. Do collection agencies have the right to force a person to give up thier acct. info?

Re: Medical Collection agency
The tactics of the collector violate the Fair Debt Collection Practices Act. She would not have sued over $445, and to threaten that is to make a threat that she has no intention of following up.
Stop her access to your account. You can tell the bank you withdraw the authorization, and you should do that in writing. Contact the FTC and file a complaint against the collector and the collection agency.
You should make payments on time pursuant to your plan, but you have the option of writing checks, and do not have to give her the banking information.
Good luck.
