Legal Question in Credit and Debt Law in Missouri
Owed Money for Daycare Expenses
I used to run a daycare facility out of my home. One of the children I watched has unmarried, split parents. The mother placed him in my care, and for the first 8 months hardly paid me anything, and once a court order was in place, she rarely paid what she was supposed to. The father disagreed with the placement in my care, and paid what he believed to be reasonable, but on a regular basis. They went to court, and the father ended up owing me about 700, but got a ruling in his favor. They issued an order stating what he owed me, but not what the mother owed me. In short, she owes me over $6000. I've sent letters to her and her attorney, but they will not respond. Legal aide will not help me, and I can't afford an attorney. What are my options and what should I do?

Re: Owed Money for Daycare Expenses
My recommendation is to sue in small claims court. If you have documents taht show what this woman owes you, and you can document that she hasn't paid you, you can sue her in small claims court and get a judgment. Then, if you know what bank she does business with, you can garnish her bank account if she doesn't agree to pay you after the judgment.
Small Claims Court can only be used to collect debts up to $3000, so that's the most you can sue for.
Your other option is to pay a collection attorney approximately 33% and have the collection attorney get you your money.
