Can a payday loan company take me to court over an unpaid loan that wasn't able to payback?

Inability to pay is not a cognizeable defense to an unpaid bill. There are things that can prevent a case from being in court, but you did not mention any of them. Perhaps you or your attorney can work out a payemnt arrangement with thr creditor.
