Legal Question in Credit and Debt Law in Missouri

Post Dated Checks

I have been told by numberous people that writing a post-dated check is illegal. If so may I have the statute so that I may obtain a copy of it to show to this obnoxious harassing bill collector?

Re: Post Dated Checks

I am not aware of any statute making apost dated check illegal. What you may have misunderstodd is that the date on the check has little significance unless it ios more that 90 days ago. When you post date a check, in almost every case, you are not preventing the payee from cashing it before that date. Unless you make specific arrangements with your bank, they will attempt to honor a check that bears your signature even if it is dated for some point in the future.

Good Luck,

Tony
