Legal Question in Credit and Debt Law in Missouri

we are 3 months behind on our car loan. What are the laws as to what and what not the repo man can do to us? I have a daughter who plays AAU basketball and she has a tournament out of town over the 13th-15th of June. My wife is afraid she will be stranded out of town. We plan on turning in the vehicle when she returns. Can they follow you? Can they get the van while she is pumping gas? Can they sit outside my home all day? It's quite nerve wracking. Thanks for your advice.

The repo people can't create a breach of the peace, and they can't harass you. However, just sitting out in front of your house is not enough to constitute harassment. They can take the vehicle any time it is not occupied. For example, if you drive to the dry cleaners to drop off your laundry and they follow you, the moment you disappear they can take their key, seize the vehicle, and be gone.

Your best bet is to turn in the vehicle voluntarily. That will end the anxiety.

You may be able to take bankruptcy, but should consider doing that sooner, not later. Changes in the law that take effect very soon could strip you of valuable rights you now possess.
