Legal Question in Credit and Debt Law in Missouri
is a Repoman collection agency?
I purchased a vehicle from a buy here pay here lot in 2006. In nov 2007 I fell behind on the payments and they tried to repossess my car. I had moved from where I was living in the original contract I did not intentionally forget to tell them my new address, but then the repolady tracked my mom down and told that if she did not tell her where the car was she would have me arrested for auto theft by deceit and my mom for aiding in a criminal action. My mom called me from her own cellphone and let her talk to me. I told her I just needed 2 more days and would have the money but she insisted I was going to be arrested. I hung up and called the finance company. they then were constantly harrassing me and my wife calling 2,3 and 4 times a day sometimes before 7am I have since payed the remaining balance and in good standing but can I go after them for violating the Fair Debt Collections act. They have also been harrassing me if I so much as fall one week behind or it just seems like any chance they get. Also I can seem to find a lawyer in my area that knows anything about this.

Re: is a Repoman collection agency?
a REPO man may be a collector under the technical terms of the FDCPA. However, you may not be able to go after themn for everything they did. You did not say where in the state you live. But, there seem to be attorneys all over Missouri that are familiar with the FDCPA. There are few that take cases against collectors, but their numbers are increasing.
