Legal Question in Credit and Debt Law in Missouri
Request of Financial Documents
Can an attorney who is sueing me, legally request personal financial docments such as check stubs, bank statements, deeds, titles, etc? Or, is this his way of finding out ways to garnish, etc.
Thanks!

Re: Request of Financial Documents
The scope of discovery in Missouri by rule is anything that is likely to lead to the discovery of admissible evidence.
If the lawsuit was over, for example, your failure to pay a bill, and your defense was "I paid the bill" he can ask to see the stub of the check where you claim you paid the bill.
But if the debt arises out of a traffic accident, for example, and he wants all your personal financial information, that is probably overreaching as it is unlikely to lead to the discovery of admissible evidence.
If you have questions on this, however, you should check with a lawyer.
