Legal Question in Credit and Debt Law in Missouri

already set up payment arrangments

in order for this credit collection agency to settle at a fair price, and freeze the interest, i had to set up payments on their terms, $384. per month for 3 months. my husband and i are very concerened about meeting this amount per month. i should not have done it but i did not want it to go to dourt. my question is, if i call them and tell them NOT to take these funds out, can they still do it now that they have my banking information. what steps should i take.

we have also been thinking about a credit cousiling agency, is that a good idea?

Re: already set up payment arrangments

I would advise you to immediately seek help from the credit counselors. If you revoke your authority for them to transfer the money from your account, the bank will not transfer the money. But you need to revoke the authority in writing. Something simple and signed by both of you will do:

My name is XXX and my wife's name is YYY, and we have an account with your bank number 12345678. We issued an authorization to ABC company to withdraw 384. We now revoke this authority effective immediately and withdraw our consent to an electronic debit.

Go to the bank with this paper, sign it in front of their notary, and give it to the bank. That will prevent them from taking the money if you get there before the date that the withdrawl is to take effect.

Go to the credit counselors and they can freeze your interest and fix your entire credit problem.

Collection agents are the lowest of the low. They lie, cheat, and would collect stale breadcrusts from a beggar if there was a fee in it for them. Go to www.ftc.gov and learn what your rights are under the Fair Debt Collection Practices Act, and never give another one of these cretins such an authorization.

Good luck
