A small business owes $8500 to a payroll company but does not have the funds

A small business owes $8500 to a payroll company (Paychex), but cannot pay yet due to business being slow. The business has offered to set up a payment plan with the payroll company, but the payroll company refuses to work with them and calls them names on the phone, then threatens them with prison. How can the small business get this taken care of without going to jail, but when they monies become available?

Unless the business owner committed fraud or wrote bad checks, a simple dispute over money would not be a criminal matter. You could be sued, and a judgment could be entered, but you wouldn't go to jail over it.

In terms of dealing with the company, I would recommend hiring a lawyer and letting the lawyer handle it. It's the easiest way to do it.
