Our son had a Capital One credit card with a $500 limit. They suffered financial hardship and got behind on their payments. They just got a summons to appear in court in about a month. Capital One states they now owe $1,200 , with the late fees and over-limit fees incurred because of the late fees. They are barely getting by now, especially since they were 'surprised' with a third child. Our son has the only income, as day care is too cost prohibitive (live in a rural area where most make min. wage...day care would eat up any salary his wife would make, if she could even find a job...) Do they have any legal recourse to get some or all of the exhorbitant added-on fees diminished or waived? Thank you for your time.
