Being Sued For Advertising Bill with no signed Contract
I am an owner of a small Bus in Jefferson County MO. I was talking with a Radio Station about advertising and working out an agreement. I cut a commercial with the station and never OK'd it to run. It began running and I notified the Station Manager that the add would need changed and we needed to work out an agreement on price etc. The ad was never changed the Manager began billing me and harrassing me for a months' payment. I then told him the ad was to be stopped ( 25 days after the wrong ad began running) and I no loneger wanted to do business with his Org. they then sent me a bill for the entire 3 months and have since Summons me to court can I use Mo Revised Statues sec 432 1-b as a defense? I believe that is the chapter for Contract law and what contracts must be signed. They are charging me interest and court fees as well Thank You

You need to retain a lawyer immediately. You may have a fraud or duress defense. The fact that the contract was not in writing may not be as significant as you think it is, given that the station will argue that you got the benefit of the advertising.
