Legal Question in Credit and Debt Law in Missouri

taking income tax returns as part of judgements

If I get a judgements against me for a credit card and a credit union loan debt that I had before i was married, now that I am married, can they take my husbands income tax return if we file together, can they touch his paycheck or his assets or checking account. I am self employed with health problems so i do not have any loans in my name. My name might be on the titles of the property but the loans are all in my husbands names. I know that they can garnish my wages and my checking account but what can they do to my husbands assets. thank you

Re: taking income tax returns as part of judgements

Marriage does not convert your debt into your husband's debt. THey cannot take joint assets, only assets that you own in your own name. To be safe, it is best if you maintain separate accounts from your husband.

Good luck.
