Legal Question in Credit and Debt Law in Missouri

Time Limit on estate collections?

My aunt that lived in Belton, MO, died 5 years ago. Today my cousin received a letter from GE trying to collect over $700 from my aunt's estate for a JCPenney account. There was no estate since everything went to her daughter (my cousin). Also, my cousin has no recollection of her mom ever having an account with JCPenney. Is there a time limit for when these debts (if it is actual) can no longer be collected?

Re: Time Limit on estate collections?

They had one year from the date of death to assert the claim. If they failed to do so, they have lost the right. A letter back with a copy of the death certificate should do the trick.
