Legal Question in Credit and Debt Law in Missouri

Wrongful garnishment

I had my bank account wrongfully garnished for a large amount of money. The judgement was for my father(same name) and his ex-wife. I hired an attorney I know, to get my money back, and I did. However the loss of use of this money for nearly a month has caused a lot of heartache since it was going to be used to do some remodeling for a house we are moving in to. I had to delay doing the work and now there is not enough time to complete. I also had all of the time dealing with this. They sent my attorney a check for my attorney fees and a release they want me to sign but I have not signed it. I'm wondering if I should go ahead and take the check and be happy they paid my attorney fees or file a seperate suit against them. I dont know what their liability is in a situation like this.

Re: Wrongful garnishment

If you have an attorney (as it appears you do) you need to ask this question of your current attorney. Asking other attorneys to comment on his/her representation asks us to substitute our judgment for your attorney's when we have very little facts to go on.
