Legal Question in Criminal Law in Missouri
If a 14 or 15 year old child is sexually assaulted when does the statute of limitation run out in the state of missouri?
Also, if that child where to tell a youth pastor about the crime committed against them is that youth pastor required to report it to the proper authorities?
1 Answer from Attorneys
The child will have a period after they turn 18, genrally two years, although there are exceptions. The victim woudl need to consult direclty with an atotrney that could have access to the facts of the cae, to get a more definite timeline.
As for the pastor, there are some considerations that come into play.
1) If the pastor had any supervisory capacity over the alleged abuser.
2) If the abuser was a minor or an adult.
3) If the program in which the victim was invloved with the pastor was connected in anyway to the government.
4) If the revelation of the news came as part of the a confession to the pastor.
5) The exact nature of the abuse.
** There woudl also be a statute of limitations as to the pastor's failure to report for both criminal and civil purposes.
Again, direct consultation with an attorney that can have access to the facts of the situation, may garner a more definite answer.
Good luck
