17 Year Old Son

My 17 year old son was arrested yesterday at his high school for burglary. Apparently over the summer he broke into an auto place and took a car and another guy with him also took a car. They drove the cars around and then left them. They questioned my son for a few hours, told them they would see what they could do about the charges since he was honest and cooperated and then they let him go. He is 17 and treated as an adult so they would not give me any information, but no charges have been filed. Do I need to go ahead and get a lawyer or should we wait until he is charged with something? Is there a possibility he might never be charged? He signed something, but I have no copy of what he signed and again because they consider him an adult in Missouri they will not give me any information. Please let me know.

I completely understand how you would like to hope for the best, but I have been handling criminal cases for almost thirty years and from my experience it is most likely that your son will be facing criminal charges. Once the charges are filed, a warrant will be issued for your son's arrest. Then, after he is taken into custody, you will need to hire someone to assist you in obtaining his release and in defending him on the criminal charges. In many cases it is better to hire an attorney ahead of time. Sometimes we are able to monitor the warrant office and enter our appearance as the defendant's attorney of record before the defendant is taken into custody. Then, we often file a Bond Reduction Motion and attempt to negotiate a deal which will allow the dendant to be released from custody pending trial as quickly, efficiently and inexpensively as possible. We often can set up a voluntary surrender which will avoid the defendant being taken into custody at an inconvenient time, and make the defendant's processing time as short as possible.
