Legal Question in Criminal Law in Missouri
I am a 58 year old woman and I have been charged with 3rd degree assault. This is mt first time to ever be in any type of trouble . The woman that I assaulted put her hands on me first, I then hit her several times. I am told that I am the one being charged with assault because I was \"in her space\" before she shoved me. What I would like to know,am I looking at any jail time? Oh yes, this woman is also disabled. This is something that I was not aware of at the time. I question just how disabled she really is. I am sure she is one of those people who screws the system!

It is possible, but uncommon for there to be a jail sentence for a first time 3rd degree assault conviction. You may want to retain counsel to advise and perhaps represent you as to your specific situation.
Good Luck
I strongly advise you to hire the very best criminal defense attorney you can afford. The previous response may be true generally speaking, but in many jurisdictions the prosecutors and the judges can be very tough even on first time offenders. If you are in the Eastern part of the state, I may be able to offer my services or refer you to someone. Please feel free to contact me at the office for a free telephone consultation.
