Legal Question in Criminal Law in Missouri

abuse of protection order

When my wife and I were going thru our divorce she threatened to say I sexually abused my two step daughters (the younger of wich I had adopted after her real father had been forced to relenqish his parental rights in a simaliar do or die situation) unless I gave her 10,000 dollars, all of the marital assets that she wanted and relinquish my parental rights. I broke to the pressure and complied to all but the 10,000 wich was impossible for me to raise.she also had a protective order placed against me. She said sorry and it did not mean anything. We talked, she let me see the children if money was involved, but every time I said something she didnt like she would call the cops. After she calmed down she'd lure me back with my daughters. Then my oldest child wrecked her 96 blazer(I co-signed),and refused to make payments. My ex wife contacted me again, told me the bank was going to repo the vehichle,I made arrangements to take over loan, I got the blazer, she kept the insurance check, and called the law. They now have charged me.I will retain a lawyer, but would like an opinion on what recorse I have for this year of hell.

Re: abuse of protection order

You needed good legal advice the very first time your ex blackmailed you with threats of false allegations. Now, your failure to get or to follow such advice has placed you in an extremely unpleasant situation which will be extremely difficult to rectify. I would suggest that you contact an attorney with lots of domestic relations experience in the county in which your divorce was granted, and make an appointment for a consultation. Be prepared to take every single legal document you have in your possession regarding these matters to the attorney for review. The attorney should interview you to ascertain all of the facts the attorney will need, and the attorney may also need to conduct some legal research in order to be able to advise you whether or not it will be possible to straighten out this mess you have become involved in. The attorney will deserve to be compensated for time and effort expended, no matter what the advice turns out to be. I suspect that you will be told that it will be necessary to file legal proceedings against your ex-wife in addition to sucessfully defending whatever charges you are facing at this time. If you are located in the Eastern half of the state you may call me for a brief but free telephone consultation at 314-727-2822. I have handled many difficult domestic relations matters, as well as criminal defenses, over the last twenty-five years mostly in St. Louis County, and surrounding counties. No matter who you call, call someone as soon as possible and put an end to the madness. Good luck!
