need help

what amount is technically considered posession of c/s? my vehicle was searched and a canine was even used and they found a small straw w/ white residue. Now they are trying to charge me w/ felony posession. can they get away w/ this

In Missouri possession of even a minute amount of certain controlled substances is considered a Felony. You might have legitimate issues with the search and seizure which could be developed by your attorney as a basis for a Motion to Suppress the evidence seized by the police. You might also have a possible defense if there is not enough of the controlled substance to allow for the prosecution's chemical tests and an independent chemical test performed at the request of your attorney. In other words, if the testing consumes all of the controlled substance, you might have a defense. If you are not already represented by an attorney you should hire one immediately. If you can not afford a private attorney, you should be able to get the public defender. I handle Felony cases and have a good deal of experience with drug cases. You may feel free to contact me.
