Legal Question in Criminal Law in Missouri
arrested for same crime twice
A person has a warrant issued and is arrested for the crime of assault . Spends a week in jail. Finally someone gets her out on bail through a bondsman. At court the witness does not show up and the prosecuter dimisses it but says he is going to refile. He does. Another warrant is issued for her arrest with a $15,000 dollar bond with no %10 percent. How can this happen? It is the exact same charge, for the exact same crime. In both cases it is The State of Missouri versus this person.

Re: arrested for same crime twice
The prosecutor does have the right to refile, and there is no requirement that the Judge set the bond at the same amount as the bond on the case previously brought. If your friend is still in jail, someone needs to hire an attorney to represent her. The attorney may be able to persuade the Judge to lower the bond or accept a ten percent cash bond. Then, the attorney can work on defending your friend. Good luck.
