Legal Question in Criminal Law in Missouri
Bad checks
First I'd like to say that this is about my boyfriend. In 2005 he was in St. Louis and was using drugs. He has a warrant there for paraphernalia with a bond of $200. He also is wanted for questioning, but the police won't say why. He wrote some bad checks there, several to stores that he is currently paying. But one was to an individual. My boyfriend cannot remember how much it was for.
He has since got clean and sober and has been that way 2 1/2 yrs now. He wants to take care of it, but he's afraid if he goes there he will be locked up and loose his job.
So finally my question is, what could happen if he went there with or without an attorney?

Re: Bad checks
If there is a warrant out, your boyfriend could be picked up and taken into custody anytime he is within the state. If he hires an attorney it is possible that the attorney can get the warrant cancelled, and then represent your boyfriend on the underlying charge. Even after the warrant is cancelled, the police can take your boyfriend in "for questioning" any tme they find him within the state. The police can hold him for twenty hours without charging him with any crime. If they already have enough evidence to charge him with any of the bad checks, they will do so. If they do not have enough evidence, they will do everything within their power to obtain a confession from your boyfriend. If your boyfriend is taken into custody either on the warrants or just for questioning, he must be strong and refuse to answer questions or make any statements. He should ask to be allowed to contact his attorney. NO MATTER WHAT THE POLICE SAY OR DO your boyfriend absolutely must decline to make any statements to them. I would strongly advise your boyfriend to hire an attorney now, and get started taking care of these problems, before he is taken into custody. If he does not already have an attorney, either you or your boyfriend may call me for a free telephone consultation.
