Legal Question in Criminal Law in Missouri
My brother is in jail for probation violation. he wrote a bad check for $10,000.00 and has not made any payments on it for 10 months. Can he talk his way out of jail? Will he go to trial? What happens to him?

When considering an allegation of a probation violation, the judge may consider placing your brother back on probation or institute the back up ( the sentence that was to be served absent probation) It is unlikely that your brother will go to trial, as he has probably already plead guilty in order to get probation. However, a protracted probation violation hearing can be somewhat like a trial. Your brother probably should have legal representation, if he hopes to avoid jail time.
