Legal Question in Criminal Law in Missouri
Capias warrant
A judge in one county KNOWS the criminal is incarcerated in another county jail and cannot get to the hearing, puts out a capias warrant on the criminal, is this legal?

Yes. Believe it or not, being incarcerated elsewhere is not an escuse for failing to appear in court. The incarcerated person, his family or friends, can hire an attorney to appear in teh second court in the place of the incarcerated person.
