Legal Question in Criminal Law in Missouri

My college student is renting a house with two people who were not paying bills. My student reported this to the owner, who now wants the other two out of her house. The two physically threatened my child and plan to continue the threats today.

Police were called. Not much could be done because the threats were over. Owner cannot remove them until 30 days. 1. Is this correct? 2. Can my child file a restraining order?

If the threats are foolowed through, then the police can remove the offenders due to the domestic violence claim. Under these facts, your child can seek a temporary restraining Order. it may not b emake permanent if there is no assualt or battery. the law opresumes that a person (your child) would not stay in an unsafe environment whre there are believable threats. The onus is on your child to leave until there is actual violence. If the other two are on teh lease, the landlord must go through proper court procedure to evict them. That can take thirty days or more.

Good luck
