Can a consumer file charges and sue a Jackson Hewitt Tax services for allowing her tax refund check to be stolen and then not writting a new check to her?

Filing charges usuallu connotes a criminal prosecution. That can only be done by a prosecutor. The victim can, of course, file a police report. The victim can also sue the negligent party (Jackson Hrwitt) in civil court.
