contractor took our money and did not work
My husband and I hired a contractor to remodel our kitchen. on jan. 30 we agree on cabinets and wrote a check for $4100.00 to begin the work- the rest would be paid when job was finishhed. to make a long story short- he has done no work- tells us the cabinets are in- but breaks every appointment to start work. we have begged him for the cabinets so we could do the work ourselves- since the kitchen has been gutted (by us, instead of his company) and we have no kitchen. he will not give us the cabinets or our money back. he will not return phone calls- i believe the cabinets were never ordered- and our money is gone. can my husband and i file a police report and have criminal charges for faud and stealing? thank you.

Yes- You can file apolice report and claim theft by deceit. But, The police may not do a lot with your claim. They may view it as a civil matter, not a priority criminal matter. You can also report this contractor to the Attorney General's office and the Better Business Bureau.
Your best bet may be to do all the above and sue the contractor in civil court. Your case is large enough that it would be worth while to hire an attorney.
