Legal Question in Criminal Law in Missouri

Contrbuting to a minor

My son had some friends over they were playing cards and yes there was alcohol there. They got a little to loud. Living in an apartment the upstairs neighbors called the police. When they got there, come to find out there were 3 underage people there besides the others. The police took the 2 youngest ones to the station and cited my son for contributing. He claims he didn't know how old they were. The one they didn't take was 19 and I spoke with him on the phone he told me he was 22 when I asked him his age. This is his first offense for something like this. What is the most that can happen to him by law. Also, the police left the one guy behind and said he could drive home. After he waited a little while. Something doesn't sound quite right to me.

He is due in court on the 18th of June and also is suppose to have surgery for a new pacemaker. Should we hire an attorney. We can't the chance of him going to jail. There are other situations coming up that are very important that he is able to attend.
