Legal Question in Criminal Law in Missouri
my daugter is 14 and her and other girls took a video of a girl with out her permmision of her having sex with a boy and is being charged with a felony sexual explotation we live in MO . does this sound right
1 Answer from Attorneys
In Missouri, a person can be charged with felony sexual exploitation of a minor if they create obscene material with a minor. Also, it is felony first degree invasion of privacy if they film someone nude or partially nude without their consent in a place where there was a reasonable expectation of privacy, and the image is subsequently distributed. Therefore, based upon the facts stated, your daughter was properly charged. It may be possible that there are defenses to this charge. In any event, I would not have your daughter plead guilty to this charge. I would urge you to contact a lawyer immediately to discuss this in detail. Feel free to contact me if you want to discuss options and outcomes.
