Deadbeat Dad needs help "Coming Out"

Hi ,

My Son is 42 years old

he is 8 years behind in his child support and

has been homeless for the past 7 years +,

He wants to do the "Right" thing but is afraid

he'll go to jail, he has not earned any income

for 8 years and has just lost "Hope" . is there

any sort of amnesty program for Deadbeat Fathers ?

If he turns himself in will they go easier on him ?

Being indigent will a judge automatically jail him ?

Would it be wise for him to get a job then turn

himself in so the judge can see his intentions ?

Would they arrest him on his new job if the arrears

are in ca & NV and he now lives in MO ?

My response to your question is necessarily general because it involves the law in three jurisdictions which may very well differ. In general, then, every state has laws to punish parents who wilfully fail to provide for their children. The word "wilfully" is important because an inability to provide is a defense. On the other hand, the arrearages are growing with interest and your son will continue to be liable for payment of support in the amount that was ordered. He can go to court, explain his circumstances, and ask for a modification. This is what he should have done 8 years ago. As a practical matter, the authorities do not like to throw delinquent parents in jail because then they can't pay support. He should see an attorney who can advise him of the options available before this gets any worse.
