Legal Question in Criminal Law in Missouri

My ex-husband was sentenced in 2007 to 2yrs bench probation in Taney Co. Missouri, he never checked in with the probation office, and failed to appear in court, once before his sentencing, and once after his sentencing. If (when) he gets picked up, will he have to serve the full 2 years, even though the actual period has expired now, and if he gets arrested in another state, will they extradite him to MO to serve his probation period? Original charges were drug-related

There are mny variable to determining his likely fate. You did nto state if his was and SIS or SES probation. If it was a state felony drug charge, he might get extradited. The fact that his original probation period has ended, may not change the fact that he violated the terms of his probation. but, it may help him get his probation reinstated. His attorney can argue that he did not violate any laws during the probation period. If he had two years probation, it is unlikely that he had a two year sentence (called a back-up) If he gts caught breaking the law,a nd is brought back to Tanely county, then he might have to do whatever his original sentnece was.

Good luck
