Legal Question in Criminal Law in Missouri

expunging misdemeanor charge of drug possession

In 1998, I was arrested for misdemeanor possession of marijuana and, as I had no money for a lawyer, plead guilty and paid a fine. I have no other legal issues. As I would like to work for the public schools, what are my chances of having this expunged as outlined in Missouri Revised Statutes 610.123?

Re: expunging misdemeanor charge of drug possession

It looks like you've taken the time to read a statute. But, unfortunately, the statute that answers your question appears to be 610.122 not 610.123. Under the controlling law, it appears that the answer to your question is "NO". This is an extreme example of why a person should hire an attorney when he needs one, even if it would mean going to extraordinary efforts to obtain the money to do so. The consequences of failing to hire an attorney can, and all to often do, effect a person for the rest of his or her life.
