Legal Question in Criminal Law in Missouri
extradition between states
Being released from IL 6/21, no parole. Formal probation in MO, 1st off. for sm. amount meth & pipe. Need to travel to CA on 21st to be with disabled & ill mother. PO says no. Tried to contact PO since Sept. to request transfer. Ignored until last mo. when mom called him. CA is backed up for 5 mos. PO said call judge, ask for unsupervised No home, no fam. no friends in MO. Is it likely that MO will extradite from CA for probation violation? Would this be considered as more than a parole violation.

I'm not going to answer your question, because I think it's the wrong question. Better answer is suggested in your question: Have your lawyer go to the Judge who placed you on probation to request the right for you to travel to CA on release from jail. Attorney can explain everything you've related here, and the Judge can allow the travel. End of issue, and you're not trying to modify your formal probation to informal probation, and, more importantly, there won't be a probation violation because you will not have "abandoned" your probation. Then, apply for a transfer of your probation from MO to CA. It shouldn't be denied, but will take months, because everyone is backed up for months and they all hate transfers. But it's yours for the asking with any good reason. No connection to MO and a sick mom in CA who needs you is good reason to me. Shouldn't be a problem (famous last words). If you'd like to discuss this further, don't hesitate to contact me. Good luck. Steve Mandell
