Legal Question in Criminal Law in Missouri
Failure to Appear (Pass Bad Check)
I had a warrant for my arrest for failure to appear with a original offense of pass bad check. They said if i pay the amount owed my court date will be cancelled and charges cleared. Is this true, even with a failure to appear. I am more than happy to pay the amount owed now that i know what is going on. I just dont want misleading information that will bring other legal actions. I dont get into trouble so i dont know the procedures for this stuff.

Re: Failure to Appear (Pass Bad Check)
The usual procedure is to hire an attorney who will attempt to get the warrant cancelled. The attorney may also be able to appear in court for you since you are going back on active duty. Sometimes,if this was a municipal charge, the clerks can be very nice about cancelling the warrant and being helpful, but this is actually something for the prosecutor and the judge to do, so I would be very carefull. Also, your post mentioned Cole County, so you are probably dealing with a state charge. It's great that you can make restitution, but you may find yourself being placed under arrest if you just walk in to pay yor money without taking care of the warrant first. Do the smart thing and hire an attorney.
