Legal Question in Criminal Law in Missouri

My fience was ticketed for "possession of a controlled substance" on the river by a parks police officer. He works at a federal halway house so he can NOT have anything of this nature on his record. The parks police officer told us if we just simply pay it, it will go away. This sounds fishy to me. We can not risk this being put on his record i know once you pay it you are pretty much assuming guilt of the incident. He was NOT in possession of anything when the officer got to him all he did was hit the pipe and pass it no one had anything on them when the officer approached us. It was actually throw in the water and found later so how exactly is this possession? They think cause they saw him hit the pipe throught their little binoculars they can charge him with such a harsh charge ummmm NO!!! If anyone has any advice for me please give it to me and if it is true that i just pay it and it goes away i would like to know also i would just love for it to go away i dont wanna drag it through court. thanks :)

If he pays it, he is admitting guilt. It sounds like your fiance needs to retain counsel to represent him in this matter. If there is no evidence, then he shoiuld not be convicted.

I agree that your fiancee should hire an attorney. It may be possible for the attorney to make sure that the charge is dismissed or at least that a plea bargain is worked out that would avoid a conviction. I would definitely not rely upon the advice of the person who issued the ticket!
