being forced to jury trial

my husband pled guilty in april. at his first sentencing date, the judge refused to sentence as the attorneys could not agree on the enhancement points. at his second sentencing date the judge said he will not sentence, and that my husband's plea has been set aside and he must now go to jury trial. can my husband be forced to go to trail like that? they are federal charges.

Without more specific information, general information can only be provided on your case. Normally, anytime prior to sentencing the judge can set aside the plea(s) and have the trial proceed onto a jury trial. This provision is to protect the alleged accused's rights. Federal criminal courts are very rule driven and the judges will follow those rules to the letter.
