Legal Question in Criminal Law in Missouri

I have this friend that found out that he is wanted for questioning for an inccident that he was nowhere around when this crime was being committed. The person that did the crime is incarcerated and used my friend name hoping that he can be a witness and clear his name. honestly we dont no if the friend is only saying that he wants my friend to clear his name. The system is tricky and my friend doesnt want to go through with this process of trying to prove his innocence. The victum has told my friend and showed him papers that his name is not involved in the case. The victum implicated the one and only person who did the acts of crime to him he also assured my friend that he will call and let the detective know that my friend dont have anything to do with this. My friend has some traffic warrents and dont want to go to jail on some crime he didnt committed. basically my questipn is what should my friend do. should he call the detective and find out whats going on? sholud he sit back and not worry about being wanted for questioning because he didnt do it? any advice. Thanks im advance

Michael R. Nack Michael R. Nack, Attorney at Law

Your friend should not contact the detective and under no circumstances should your friend make any statements or answer any questions at all. Your friend should hire an attorney to represent him or her. The attorney can get the warrants cancelled and deal with those legal problems. The attorney can also prepare your friend for the possibility that he or she will be arrested and charged. Then the attorney can defend your friend if necessary.
