Legal Question in Criminal Law in Missouri
My husband has been falsely accused of statutory rape. At the time of the alleged statutory rape (2001), the statute of limitations said the charges had to be commenced within 10 years of the alleged victim turning 18. In 2004, the statute of limitations was changed to 20 years after the alleged victim turned 18. The charges were pressed one month AFTER the alleged victim turned 28, so NOT within 10 years of her turning 18. Which statute of limitations apply? The ones in place at the time of the alleged crime or the ones in place at the time the charges were pressed?

Of course, there may be facts that alter the analysis. But, since the statue of limitations was while your husband was still in jeopardy, the new limestone period may be effective against him. He should discuss this issue with his attorney.
