Legal Question in Criminal Law in Missouri
My husband received SES and 2 years probation to be supervised upon release on a charge he has. He is held in a different county jail then where he was sentenced. He then got in trouble in another county jail and received an extra 15 days for breaking a food tray. Beings he won't be released to start his probation when he is supposed to can the judge revoke his probation for this.
1 Answer from Attorneys
How did he receive an extra 15 days? Your question does not really provide enough specific information. The first basic condition of anyone being placed on probation is that the person obey all laws. So, any incident in which your husband violated any law would be grounds for revocation of probation. But, it sounds like your husbnand's probation does not even start until he is released from custody, so there would be no revocation. In any event, an attorney would have to know all of the facts in order to offer any competent answer to your question.
