Legal Question in Criminal Law in Missouri
Illegal search w/out warrant
During a search of a residence does a warrant have to be given to the occupant of that residence if he is home? And does the law have the right to enter such residence if occupant is outside of his home w/out seeing such warrant or giving verbal permission?

Re: Illegal search w/out warrant
The answers to your questions depend upon a variety of factors and can not be easily ansered in a forum such as this. If your residence has been searched subject to a warrant, then it sounds to me like you or someone else is in some kind of trouble. I would strongly suggest that you consult with a criminal defense attorney to determine what your situation is, and whether or not there has been an illegal search and seizure which might be grounds for a Motion to Suppress. If you are located in the Eastern half of the state, I would be willing to give you a fee telephone consultation. You may call me at 314-727-2822.
