Jail Time

First time offender - I have been arrested and charged with intentionally stealing miscellaneous grocery items valued at $ 36.40. The actual charge is CO 50.106. Am I going to jail ? This is a first offense and it is a misdemeanor.

The facts included in your question suggest to me that you were charged with the violation of a County Ordinance, which makes it a somewhat less serious matter and which probably lessens thte penalties you are facing. I would not worry too much about going to jail. I would be very concerned about having a conviction for this type of charge on my permanent criminal record. Since you are a first time offender, it is likely that a plea bargain could be negotiated by your atttorney and the prosecutor or county counselor which would have the effect of avoiding a conviction being placed upon your record. You should definitely hire legal counsel if you can afford to do so.
