Legal Question in Criminal Law in Missouri

Judge holding personal grudge against husband

My husband is currently in jail for a misdemenor probation violation. Though he was only sentenced to two months he has been in jail for three months now. The judge has said she is holding him because of another offense which is something he hasn't even went to trail for yet. She wont even let him go to counseling that my lawyer and I think he needs. Is this legal?

Re: Judge holding personal grudge against husband

Is "your lawyer" also your husband's lawyer? If so, your husband should obtain his legal advice from his attorney. If you husband chooses to discharge his attorney and hire a replacement then he will be able to do so.If your husband is not represented by counsel, he obviously should be. If he is not represented by counsel and can not afford a private attorney he should apply for the appointment of the public defender. Good luck.
