Legal Question in Criminal Law in Missouri

Hi I left a question for you and you did answer it but you said you needed a little more info...what has happend was my boyfriend has had a prior class b felony for a drug charge he was cought with crack cocain and took a plea bargin of 5 years probation and 10 year back up and he was out for a year and has cought another charge of the same thing he was at a house that was kicked in and they found drugs on him... i've talked with his lawyer and im trying to get him to see if maybe he can get like a 6 month treatment program because he also has a drug problem so i think that would be the best maybe with more backup time but he thinks that will be hard to do. these prosecutors are very tough to deal with sometimees....thanks for your time i really am grateful for your help

In Missouri, drug defendants are between a rock and a hard place because of the state's failure to fully fund drug treatment centers. I agree that treatment is far better than throwing a user in with the general prison population. I hope you and your lawyer can persuade the DA to recommend treatment and get the judge to OK it. The problem is, there are about 100 applicants for every spot, so the odds are long. Don't hesitate to pressure legislators to approve more money for treatment. It is far cheaper to treat an addict than to jail him. Good luck to you both.
