Legal Question in Criminal Law in Missouri
Do They have the right?
I met a person through a friend thought they seemed to be a nice person well I had a coupon for a hotel and my husband and I were going to utilize when we ran into this friend and they said they were going to get a room so we just gave them ours of wich they could just pay us what we paid the next day 2 detectives showed up at my door wanting to ask questions someone had stolen a laptop from our friend then I unfortunatly had a warrant from a fine I couldnt pay 2 weeks prior and intended to pay this week so I was taken in because of that wich is no problelm I could pay the fine and be done with it so I thought but 4 hours later they tell me that they are keeping me on a 24hr investigative hold and said that they were going to charge me with ''possible user and posession of paraphanelia'' I found out later that this person we gave our room to supposidly is being investigated and because they said the room was in my name that I was responsable for it, however, the room was not in my name nor did I sign for the room my husband did they said I used a cc I did not I have one on file but never have used it paid cash, they never read me my miranda until they interrigated me 4.5 hrs later how can they do that? when I wasnt on or in room?

Police are supposed to give you your Miranda rights and get you to waive them if they intend to use a statement by you in evidence against you. So, if you were thinking that they had to give you your rights when they arrested you, you are wrong. If you were not in the hotel room, what evidence do they have that you were in possession of drugs or paraphenaliia? If there is no more to it than that, you should hire an attorney to represent you and you should be able to defend this charge.
