Legal Question in Criminal Law in Missouri
I got an mip tonight, and technically I was in a gated community behind the fence when the sheriff called me to his car where he proceded to breathelize me and I failed :( is there any kind of issue here that would make a standing in court to prevent community service, probation, too large of a fine, or a loss of license for me?
1 Answer from Attorneys
The fact thatyou were in a gated commuy does not provide you with any defense to the charge. However, there may be other defenses available depending upon the exact facts. I would strongly advise you to hire an attorney to represnt you. Your attorney will determine whether it would be in your best interest to fight the charge or to enter into a plea bargain. The negative consequences that could result from this charge makes it extremely important that the matter is handled correctly. I have handled hundreds of similar cases in the thirty-three years that I have been practicing law and I might be able to offer my services to you if you are located in my geographical area. If I can't help you myself, I might be able to refer you to someone who can help. Please feel free to cntact me.
