Legal Question in Criminal Law in Missouri

misdemeanor bad check charge

My daughter ple guilty to passing bad checks that were actually signed by her boyfriend and cashed by his sister at the grocery store where she works. He talked her into pleading guilty since he is already in trouble with the law. How do I go about getting the plea withdrawn so she can prove she did not sign these checks. The account was joint with the boyfriend but is now closed.

Re: misdemeanor bad check charge

It may be possible to file a Motion to Set Aside the Guilty Plea, but you muyct act immediately. It is likely that the Judge asked your daughter at the plea session whether anyone was forcing or coercing her to plead guilty, and your daughter probably answered "No." on the record. Still, she might have a chance to set things right if he acts promptly. Consult with and hire an attorney as soon as possible.
